Workers’ Compensation Update: Nevada’s 82nd Legislative Session and 34th and 35th Special Sessions

Following are important new bills to be aware of and changes to look for from the last legislative session.

  • AB 165: This bill revises provisions governing payments for a PPD award in lump sum form and confirms any amount over 30% must be paid in installments. This bill went into effect on March 22, 2023.
  • AB 244: This bill adds a 21-day notice requirement for certain physical examinations as well as penalties for interfering with the examination process.  This will apply to NRS 616C.140 IMEs and is unclear if it will apply to NRS 616C.145 IMEs requested by a claimant. 
  • AB 410: This bill amends NRS 616C.180 by now allowing a stress claim for first responders due to witnessing an event “or a series of events.” This change expands coverage and will make it harder to argue that a stress claim should be denied because it results from gradual mental stimulus. This amendment goes into effect on January 1, 2024 for most purposes.
  • SB 274: This bill makes significant changes to the requirements for company adjusters and third-party administrators regarding administration and maintaining of records in and out of state. It also modifies requirements related to NRS 616D.120 penalties. This bill also provides clarification as to PPDs under NRS 616C.145(5). This bill goes into effect for most purposes on January 1, 2024.
