John Fortin Joins Appellate Practice and Commercial & Complex Litigation Practice
McDonald Carano welcomes John Fortin as a member of our Commercial & Complex Litigation Practice and Appellate Practice. He focuses his expertise on business litigation at the trial and appellate levels, including experience with matters involving breach of contract, estoppel, fiduciary duties, tortious interference with contracts, intellectual property, deceptive trade practices, misappropriation of trade secrets, mining law, defamation, voter initiative litigation, negligence actions, and U.S. and Nevada constitutional questions.
- Trial level experience — drafting motions to dismiss, motions for summary judgment, motions to compel, and motions for protective orders.
- Discovery experience — preparing NRCP 30(b)(6) depositions, expert depositions, propounding and responding to discovery requests, and document review.
- Appellate experience — drafting opening, answering, and reply briefs in matters of extraordinary relief such as writs of prohibition and writs of mandamus as well as post-appellate relief on direct appeals.
Mr. Fortin has argued before the Nevada Supreme Court as part of the pro bono appellate program and obtained a complete reversal and remand for his client and he also was on the briefs in a matter that obtained a complete affirmance for his client and a written opinion issued by the Nevada Supreme Court. Mr. Fortin additionally obtained trial and appellate experience as an Extern for the Honorable Judge Henry Hudson of the U.S. District Court for the Eastern District of Virginia, and as an Intern for the Honorable Associate Justice Monica Márquez of the Colorado Supreme Court. After graduating from law school, Mr. Fortin served as a full-time Judicial Law Clerk for the Honorable Chief Justice James Hardesty of the Nevada Supreme Court.
Prior to law school, Mr. Fortin served for a decade on active duty as a cryptologist and intelligence analyst for the U.S. Navy. Upon matriculation to law school, Mr. Fortin transitioned to the Naval Reserves where he continues to serve today. He received an LL.M. in Global Antitrust Law and Economics from George Mason University Antonin Scalia Law School, a J.D. from University of Richmond School of Law, and a B.A. from American Military University.
