Employment Law Priorities for In-House Counsel
On February 18, 2026, Dan Aquino, Co-Chair of our Employment & Labor Law Practice, provided a CLE to Nevada Chapter members of the Association of Corporate Counsel. Dan’s CLE titled “Employment Law Priorities for In-House Counsel” provided in-house practitioners with legal insights and strategies, as well as practical ideas to address trending employment law issues. The program addressed a wide array of new and developing employment law priorities for in-house counsel at the state and national level, including the following.
- SB 8’s clarification of the application of the Portal-to-Portal Act in Nevada (Malloy v.Amazon).
- Nevada Supreme Court’s expansion of the reach of Nevada’s “employment-luring statute” (Field Effect Security v. Eighth Judicial District Court).
- Status of wage-and-hour litigation regarding donning and doffing in light of the United States Supreme Court’s denial of a writ petition in Steiner v. Mitchell.
- FTC’s enforcement approach regarding noncompete agreements in the wake of its attempt at a nationwide ban.
- Risks involved in utilizing artificial intelligence in employment decision-making.
- Department of Labor’s consideration of proposed rulemaking addressing joint employer liability under the Fair Labor Standards Act.
- Best practices for ensuring enforceability of arbitration agreements in Nevada, particularly regarding class action waivers.
