Dan Aquino Selected to Wage and Hour Defense Institute
Dan Aquino, Co-Chair of McDonald Carano’s Employment & Labor Law Practice, is the Nevada member of the Wage and Hour Defense Institute, an invitation-only network of experienced employer-side wage and hour defense practitioners across the U.S. and Canada. Attorneys are evaluated for membership based on their expertise and track record representing employers in wage and hour matters. WHDI is a prominent resource on state and federal wage and hour law, including class and collective actions, for employers of all sizes and industries.
The Wage and Hour Defense Institute helps employers navigate the complex state and federal requirements for wages, hours of work, timekeeping, and pay practices, as well as the increasing number of wage and hour lawsuits arising under these laws. The extensive range of wage and hour related compliance issues facing employers includes:
- Exempt vs. non-exempt employee classifications
- Independent contractor classification
- Calculation of wages for hourly and salaried workers
- Remote work overtime and expense reimbursement
- Tips, bonuses, and commissions
- Compensability of training time, rest and meal breaks, and pre-shift and post-shift activities
- Class and collective action exposure and risk mitigation
The mission of the Wage and Hour Defense Institute is to leverage its large geographic platform to provide top tier representation and in-depth wage and hour knowledge to its members’ clients by attorneys who are local to the dispute and who are familiar with the local courts, local practices, and local attorneys. In addition to serving as litigation counsel, WHDI member lawyers help clients navigate inspections, audits, and actions by the U.S. Department of Labor and similar state and local agencies. WHDI attorneys also counsel employers on classification determinations and other payroll practices, helping employers avoid litigation and reduce exposure should litigation arise.
